Operational


1.    Contribute to the development of the Legal policies, procedures, and processes that will impact CNA-Q, as required by the Legal Affairs Manager.


2.    Support the Legal Affairs Manager in developing and updating the Dispute Resolution Guidelines.


3.    Manage and review the validity of disputes between parties, and ensure compliance with the College’s quality standards, processes and strategy. Conduct all investigations required to facilitate the case, assessing evidence, requesting and overseeing technical or economic expertise, drafting reports, and prepare interim and / or final decisions.


4.    Support the Legal Affairs Manager in developing strong relationships with external legal resources specialized in litigation and dispute resolution and stakeholders, as needed to obtain high quality and value added legal support in a cost-effective manner.


5.    Assist the Legal Affairs Manager in drafting and proof reading contracts, agreements, MoU’s, and templates, and identify potential conflicting statements or areas of further investigation, and ensure accuracy and quality of documents are maintained, in accordance with CNA-Q legal protocol.


6.    Provide translation of legal documents from English to Arabic or Arabic to English as directed by the Legal Affairs Manager.


7.    Provide claims analysis as well as avoidance and mitigation strategies on activities and projects with significant financial, legal and reputational exposure to CNA-Q.


8.    Keep abreast with the latest laws, rules and regulations that can impact CNA-Q, and interpret corresponding implications of legislation on CNA-Q.


9.    Manage efficiently, and as per the approved strategy, the court cases involving CNA-Q, including appeals and decisions. Represent CNA-Q in court with the highest quality standards, including the preparation of witnesses, reports and any other evidence required to ensure CNA-Q’s position is well-represented and protected.


10.  Provide effective and timely support to the Human Resources Department in handling legal disputes between CNA-Q and its employees, to promote an effective working environment within the College.


11.  Prepare appropriate briefs for litigation, pre-trial, trial, and on appeal as directed by the Legal Affairs Manager.                                         


12.  Ensure the quality assurance of any documents produced or communicated by CNA-Q in court proceedings and/or dispute resolution processes, i.e. case pleadings, statutory requests for information, and instruct external counsel when applicable.


13.  Adopt a balanced approach aimed at reaching a fair and equitable position enabling long term solutions.


14.  Develop and manage a database on litigations, disputes and complaints, ensure cases are accurately logged and tracked in line with CNA-Q database management protocol.


15.  Prepare timely reports to the Legal Affairs Manager on related matters.


16.  Review and analyze prosecution trends and outcomes, to ensure alignment with international best practice.
